Ahead of the judicial review of the Scottish Prison Service Policy for the Management of Transgender People in Custody being heard on 3rd – 5th February 2026 in the Court of Session, we are now able to publish our written submissions.

The Scottish Ministers have published their Answers and Note of Argument.

The Scottish Human Rights Commission and the Equality and Human Rights Commission have submitted written interventions to the court. SHRC published its submission on 04 February; the EHRC has yet to publish theirs.
